These Terms of Service ("Terms") govern your access to and use of the Decorb mobile application, web application, and related services (collectively, the "Service") operated by Decorb ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using Decorb, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

2.1 Account Creation

To use the Service, you must create an account using Google Sign-in or Apple Sign-in. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

2.2 Account Accuracy

You agree to provide accurate and complete information during registration and to keep your account information current.

2.3 Account Security

You must notify us immediately if you become aware of any unauthorized access to or use of your account. We are not liable for any loss arising from unauthorized use of your account.

3. The Service

3.1 Description

Decorb is an AI-powered interior design visualization tool. Users upload photos of their spaces, provide style references and text prompts, and receive AI-generated redesigns of their actual rooms.

3.2 Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3.3 AI-Generated Content

The Service uses artificial intelligence (Google Gemini) to generate design visualizations. AI-generated results are approximate representations and should not be relied upon as exact measurements, structural guidance, or professional design advice. Generated images may not perfectly reflect real-world conditions, materials, or proportions.

4. Subscription Plans and Payments

4.1 Subscription Tiers

4.2 Credits

  • Each AI generation consumes credits: 1 credit for 1K resolution, 2 credits for 4K resolution
  • Monthly credits reset at the start of each billing cycle and do not roll over
  • Credit top-ups are available for paid tiers and never expire
  • Credits have no cash value and are non-transferable

4.3 Payment Processing

Payments are processed by Dodo Payments, our Merchant of Record. Dodo Payments handles billing, tax collection and remittance, currency conversion, and payment disputes on our behalf. By subscribing to a paid plan, you agree to Dodo Payments' terms of service as applicable to payment processing.

4.4 Billing and Renewals

  • Paid subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date
  • You will be charged at the then-current rate for your subscription tier at each renewal
  • We may change pricing with at least 30 days' notice before the change takes effect on your next renewal

4.5 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings or billing portal
  • Upon cancellation, you retain access to paid features until the end of your current billing period
  • After your billing period ends, your account will revert to the Free tier
  • Refunds are handled in accordance with applicable consumer protection laws and Dodo Payments' refund policies. Contact us for refund requests

4.6 Free Tier

The Free tier provides limited access to the Service with 3 one-time credits. Free tier accounts are subject to the same Terms as paid accounts. We reserve the right to modify or discontinue the Free tier at any time.

5. User Content and Intellectual Property

5.1 Your Content

"User Content" includes all images you upload (space photos, reference images), text prompts you provide, and any other content you submit to the Service.

You retain all ownership rights to your User Content. By uploading content to Decorb, you grant us a limited, non-exclusive, worldwide license to use, process, and store your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or your account.

5.2 Generated Content

AI-generated images created through the Service ("Generated Content") are your content. You may use Generated Content for personal or commercial purposes, subject to the following:

  • You are responsible for ensuring your use of Generated Content complies with applicable laws
  • Generated Content should not be represented as professional architectural or structural advice
  • We do not guarantee that Generated Content will be unique or free from similarities to other outputs

5.3 Decorb's Intellectual Property

The Service, including its design, software, algorithms, branding, logos, documentation, and all underlying technology, is and remains the exclusive property of Decorb. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited right to use the Service as described herein.

5.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

6. Acceptable Use

6.1 Permitted Use

You may use the Service for lawful interior design visualization purposes, including personal home design, professional design work, and client presentations.

6.2 Prohibited Conduct

You agree not to:

  • Abuse the Service: Reverse-engineer, decompile, or attempt to extract source code from the Service; use automated tools, bots, or scrapers to access the Service; circumvent rate limits, credit systems, or access controls
  • Upload Harmful Content: Submit images containing illegal content, content that violates others' privacy or intellectual property rights, or content depicting minors
  • Misrepresent Outputs: Present AI-generated images as real photographs, professional architectural plans, or engineering drawings
  • Resell Access: Share, resell, or redistribute your account credentials or Service access to third parties
  • Interfere with Operations: Introduce malware, overload infrastructure, or attempt to gain unauthorized access to our systems
  • Violate Laws: Use the Service in any manner that violates applicable local, national, or international laws

6.3 Enforcement

We reserve the right to suspend or terminate your account, remove content, or restrict access if we determine, in our sole discretion, that you have violated these Terms. We may do so without prior notice in cases of serious violations.

7. Third-Party Services

7.1 Integrations

The Service integrates with third-party services including Google Sign-in, Apple Sign-in, and Dodo Payments. Your use of these third-party services is subject to their respective terms and privacy policies.

7.2 Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party sites.

8. Disclaimers

8.1 "As Is" and "As Available"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Professional Advice

Decorb is a visualization tool, not a professional design, architectural, or engineering service. AI-generated content is for visualization purposes only and should not be used as a substitute for professional design consultation, structural assessment, or building code compliance. Always consult qualified professionals before making renovation or construction decisions.

8.3 AI Limitations

We do not guarantee the accuracy, quality, or suitability of AI-generated outputs. Results may vary based on input quality, and the AI may occasionally produce unexpected or imperfect results.

9. Limitation of Liability

9.1 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECORB'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO DECORB IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

9.2 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECORB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF DECORB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.3 Exceptions

The limitations in this Section 9 do not apply to liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.

10. Indemnification

You agree to indemnify, defend, and hold harmless Decorb and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Term and Termination

11.1 Term

These Terms are effective from the date you first access or use the Service and continue until terminated.

11.2 Termination by You

You may terminate your account at any time by deleting your account through the Service or by contacting us. Subscription cancellation policies in Section 4.5 apply to paid accounts.

11.3 Termination by Us

We may suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, extended inactivity, or discontinuation of the Service. Where possible, we will provide reasonable notice.

11.4 Effect of Termination

Upon termination:

  • Your right to access the Service ceases immediately
  • We will delete your User Content and Generated Content within 30 days, unless retention is required by law
  • Sections that by their nature should survive termination will survive, including Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (General)

12. General Provisions

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

12.2 Dispute Resolution

Before initiating any formal proceedings, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days.

12.3 Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes at least 30 days before they take effect by posting the updated Terms and notifying you through the Service. Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the changes.

12.4 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

12.5 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

12.6 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Decorb regarding the Service and supersede all prior agreements and understandings.

12.7 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

12.8 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or infrastructure failures.
